1. This is an Agreement between you and Water Canada that governs your purchase to be included in the Water Canada Buyer’s Guide. You agree to be bound by this Agreement and you represent and warrant that you have the legal authority to agree and accept this Agreement on behalf of yourself or the person you purport to represent including an incorporated or unincorporated entity. If you do not agree to the terms and conditions set out in this Agreement, you must not submit a purchase order request.
2. You agree that all the information you provide to Water Canada shall be true, accurate, complete and current. You shall immediately notify Water Canada of any changes in the information you provided. Water Canada assumes no responsibility or liability for any damages that result from any false, inaccurate or incomplete information provided by you or your failure to update your information. To change any information on your will result in a charge of $50 per field change.
3. Your digital entry on the Water Canada Buyer’s Guide will be valid for 365 days. The digital entry will also appear in the next print edition of the Buyer’s Guide.
4. If the purchaser fails to pay as set out in this agreement the purchaser shall also pay interest to Water Canada at the rate of two and one-half percent (2 1/2%) per month compounded monthly, being a nominal rate of 30% per year, upon the unpaid balance from the date of default until payment.
5. There is no representation, collateral agreement, warranty or condition, express or implied, statutory or otherwise, affecting this agreement or the goods other than as expressed in writing in this Agreement.
6. If any provision of this agreement violates the law or is found by a Court unenforceable, the rest of the Agreement shall remain valid.
7. Water Canada may at its sole and absolute discretion cancel or terminate your right to use this website or any part of the website at any time, without notice or liability to you or any other person. In the event of termination, the terms and conditions of use of this website and the terms and conditions for submitting a purchase order and purchasing a Water Canada Buyer’s Guide entry shall continue to apply and be binding upon you with respect of your prior purchase order submissions, purchases of Water Canada Products and use of the Water Canada website.
